The Jordan framework works in such a way that the Crown must prove, at the end of the 18 or 30 months, why the delay is appropriate in the circumstances. One year after the Jordan case was published, the Supreme Court reaffirmed the Jordanian framework in R. v. Cody. In Cody, the Supreme Court concluded that delays caused by a lack of judicial resources cannot be inferred from the overall delay, even if the delay is due to defensive measures. The Cody decision was an important addition to the Jordanian framework by putting additional pressure on the Crown and the court system to reduce lengthy delays in the court system.
For a sued person, a delay can be more than just an inconvenience. A delay may constitute a violation of that person`s constitutional rights. Section 11(b) of the Canadian Charter of Rights and Freedoms states: “Every person charged with a crime has the right to be brought to trial within a reasonable time.” The main issue dealt with by the courts with respect to paragraph 11(b) is: When does the delay in bringing a case become unreasonable?
